Canadian Documents for International Use

As of January 11, 2024, Canada became a contracting member of the Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents (the “Hague Apostille Convention”). As a result, Canadian public documents intended for use in foreign member countries, including Albania, may now be authenticated through the simplified Apostille process.

An Apostille certifies the authenticity of the signature, seal, and authority of the Canadian official or Notary Public who executed or notarized the document. Once issued, the Apostille allows the document to be recognized in Albania without further legalization through embassies or consulates.

Special Power of Attorney for Real Estate Transactions in Albania

A Special Power of Attorney (“SPA”) is commonly used to authorize a trusted individual, lawyer, or representative in Albania to act on behalf of a person located in Canada in connection with residential or commercial property transactions.

The SPA may authorize the appointed representative to:

  • Purchase residential or commercial property in Albania
  • Sign purchase and sale agreements
  • Execute notarial deeds and declarations
  • Register title and ownership with the Albanian Land Registry
  • Obtain tax, municipal, and cadastral documentation
  • Represent the client before notaries, government authorities, banks, and public institutions in Albania
  • Complete all steps required for the transfer and registration of ownership

For use in Albania, the Special Power of Attorney is typically:

Drafted in English and/or Albanian;
Executed before an Ontario Notary Public; and
Apostilled in Ontario pursuant to the Hague Apostille Convention.
Once Apostilled, the document is recognized for legal use in Albania without further consular legalization.

The Apostille process generally involves the following steps:

Preparation of Documents

Documents must be originals or properly notarized or certified copies prepared in accordance with Ontario and Canadian legal requirements.

Notarization and Certification

Where required, documents are notarized by an Ontario Notary Public. If the documents are translated, a Translation Certificate may also be prepared and notarized.

Apostille Authentication

The documents are submitted to the competent provincial authority in Ontario for issuance of the Apostille Certificate pursuant to the Hague Apostille Convention.

International Use in Albania

Once the Apostille Certificate is attached, the documents are valid for official use in Albania without further embassy legalization requirements.
